1. Agreement to Terms
By accessing or using NotForSale.ie (the "Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Platform.
These Terms constitute a legally binding agreement between you and NotForSale.ie. We reserve the right to modify these Terms at any time, and continued use of the Platform after such modifications constitutes acceptance.
2. Description of Service
NotForSale.ie is a pre-market property platform that connects:
- Property sellers with potential buyers before properties are publicly listed
- Sellers with verified estate agents to complete transactions
The Platform facilitates property discovery, offer submission, and agent selection. We are not an estate agent and do not directly sell properties or provide property services.
3. User Accounts
3.1 Registration
- You must be at least 18 years old to create an account
- You must provide accurate and complete information
- You are responsible for maintaining account security
- You are responsible for all activities under your account
3.2 Account Types
- Buyers: Can browse properties and submit offers
- Sellers: Can list properties and accept offers
- Agents: Can receive leads and provide services (subject to verification)
4. Property Listings
4.1 Seller Obligations
As a seller, you represent and warrant that:
- You have the legal right to sell the listed property
- All information provided about the property is accurate and complete
- Property photos are genuine and represent the actual property
- The property complies with all applicable laws and regulations
4.2 Listing Fee
- A non-refundable listing fee of €25 is required to publish a property
- The fee covers a 90-day active listing period
- Payment is processed securely through Stripe
- Listing fees are non-refundable, even if your property does not sell
4.3 Prohibited Listings
You may not list properties that:
- You do not own or have authority to sell
- Violate any laws, regulations, or third-party rights
- Contain false, misleading, or deceptive information
- Are subject to legal disputes or encumbrances without disclosure
5. Offers and Transactions
5.1 Making Offers
- Buyers can submit non-binding offers on properties
- Offers are communicated to sellers via the Platform and email
- Sellers may accept, reject, or counter offers
- Acceptance of an offer initiates the next phase of the transaction
5.2 Our Role
NotForSale.ie is a marketplace platform only. We:
- DO NOT act as an agent, broker, or intermediary in transactions
- DO NOT verify property titles or conduct due diligence
- DO NOT guarantee the accuracy of listings or user information
- ARE NOT responsible for disputes between buyers and sellers
5.3 Estate Agent Selection
After accepting an offer, sellers select an estate agent from our marketplace to complete the transaction. The agreement is directly between the seller and the chosen agent. We facilitate introductions but are not party to the service agreement.
6. User Conduct
You agree NOT to:
- Violate any laws or regulations
- Infringe on intellectual property rights
- Post false, misleading, or fraudulent content
- Harass, abuse, or harm other users
- Attempt to circumvent the Platform to avoid fees
- Use automated systems (bots, scrapers) without permission
- Interfere with the Platform's operation or security
- Impersonate another person or entity
7. Intellectual Property
The Platform and its content (excluding user-generated content) are owned by NotForSale.ie and protected by copyright, trademark, and other intellectual property laws.
By uploading content (photos, descriptions, etc.), you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute that content on the Platform. You retain ownership of your content.
8. Disclaimers and Limitation of Liability
8.1 Platform Provided "As Is"
The Platform is provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding:
- Uninterrupted or error-free operation
- Accuracy, reliability, or completeness of content
- Quality of properties or services obtained through the Platform
8.2 Limitation of Liability
To the maximum extent permitted by Irish law, NotForSale.ie and its officers, directors, employees, and affiliates shall not be liable for:
- Indirect, incidental, special, or consequential damages
- Loss of profits, revenue, data, or business opportunities
- Damages arising from user conduct or third-party actions
- Property disputes, failed transactions, or seller/buyer issues
Our total liability shall not exceed the listing fee paid (€25) or €100, whichever is greater.
9. Indemnification
You agree to indemnify and hold harmless NotForSale.ie from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
- Your use of the Platform
- Your violation of these Terms
- Your violation of any third-party rights
- Content you submit to the Platform
10. Termination
We may terminate or suspend your account:
- For violation of these Terms
- For fraudulent or illegal activity
- At our discretion, with or without notice
You may terminate your account at any time through your profile settings. Upon termination, your right to use the Platform ceases, but these Terms continue to apply to past activities.
11. Dispute Resolution
11.1 Governing Law
These Terms are governed by the laws of Ireland. Any disputes shall be subject to the exclusive jurisdiction of the Irish courts.
11.2 Dispute Process

12. General Provisions
12.1 Entire Agreement
These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and NotForSale.ie.
12.2 Severability
If any provision is found unenforceable, the remaining provisions remain in full force.
12.3 Waiver
Our failure to enforce any right or provision does not constitute a waiver of that right.
